What you get, what it costs, what you may do with the results, and what happens when something goes wrong.

01The agreement

These terms are between you and TODO — registered legal or trading name (assets.baby). Using the service means you accept them. If you are using it for a company, you confirm you may accept them on that company's behalf.

You must be old enough to enter a contract where you live.

02What the service does

You describe a game. We generate a design, a gameplay screen, and — once you approve that screen — a pack of 2D art assets matched to it, with a manifest and a build brief.

It is a generation tool, not an artist and not a guarantee. We do not promise any particular output, style, quality or resemblance to what you had in mind, and results vary between runs of the same input.

03Credits

Credits are prepaid units, bought 10 to 1000 at a time. One credit produces one image: a screen render, a sprite, or an animation sheet. Designs, asset plans and exports cost nothing.

A credit is spent when an image is produced, whether or not you like the result. That is what you are paying for — the generation, not a result you approve of. Credits do not expire and have no cash value.

Unused credits are refundable at our discretion. Spent credits are not, except where consumer law in your country says otherwise. If you believe you were charged for work that was never delivered, write to us and we will look at the record and put it right.

04Statutory cancellation rights

If you are a consumer in the EU or UK you normally have 14 days to cancel a digital purchase. By buying credits and then spending them you ask us to begin immediately and acknowledge that you lose that right for the credits you have spent. Credits you have not spent remain cancellable within the period.

05Who owns what

You own what you generate. Subject to your having paid for it, we assign you whatever rights we hold in the assets produced from your prompts, and you may use them commercially, including in games you sell.

Three honest limits. AI output may not attract copyright at all in some countries, so "you own it" can mean nobody owns it — a thing to check before you rely on exclusivity. Similar prompts can produce similar output for different people, so nothing you generate is guaranteed unique. And we make no warranty that your assets do not resemble existing work; if you need certainty, have them cleared.

You keep everything you upload. You grant us only the licence needed to run the service on it — storing it, sending it to the AI providers listed in the privacy policy, and generating from it.

06What you may not do

You agree not to use the service to:

  • recreate someone else's characters, trademarks or copyrighted art, by name or by description
  • produce sexual content involving minors, or content that is illegal where you are
  • impersonate a real person, or generate material to deceive or harass
  • resell or rebrand the service itself, or use it to build a competing one
  • work around credit limits, rate limits or the free tier — including making accounts to farm free credits
  • attack the service, or attempt to reach data belonging to other accounts

You are responsible for what you type. Prompts naming a franchise, studio or living artist are your risk, not ours.

07Availability

The service depends on third-party AI providers and can be slow, rate-limited or unavailable because of them. There is no uptime commitment. We may change, suspend or discontinue features.

If we discontinue the service entirely, we will give reasonable notice so you can export your packs, and refund unspent credits.

08Suspension

We may suspend or close an account that breaks clause 06, charges back a payment instead of contacting us, or puts the service or other customers at risk. Where it is safe and lawful to do so, we will say why and give you a chance to respond.

09Liability

The service is provided as-is. To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Our total liability to you is limited to what you paid us in the twelve months before the claim. We are not liable for lost profits, lost data, or the cost of replacement art.

Nothing here excludes liability that cannot be excluded by law — including death or personal injury caused by negligence, fraud, and any statutory rights you have as a consumer.

10Law and disputes

These terms are governed by the law of TODO — governing law and courts, and its courts have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live.

Before formal proceedings, please write to TODO — support@your-domain. Most problems are a support question rather than a legal one.

11Changes

We will email the address on your account before material changes take effect. Continuing to use the service after that means you accept them; if you do not, stop using it and ask for a refund of unspent credits.
